Federal Judge Mandates Freedom of Abrego Garcia from ICE Detention
A court has ordered the immediate discharge of Kilmar Abrego Garcia from immigration custody, finding his ongoing confinement lacks lawful basis.
"Since Abrego Garcia's release after wrongful imprisonment in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis stated in her order.
The situation stems from a mistaken removal to El Salvador earlier this year, which the government later acknowledged was an error. After his repatriation to the United States to answer alien smuggling charges, he was held in federal custody.
In her decision, the court noted that the government does not have a valid removal order, which effectively blocks them from deporting Mr. Abrego Garcia "for now."
Context of the Legal Challenge
The court proceedings involve disputed claims. Whereas the former administration argues that Abrego Garcia is a member of the MS-13 gang, he categorically denies this allegation.
He has also pleaded not guilty to the smuggling counts, which are part of a ongoing criminal case in the state of Tennessee.
Conditions of Release
The court, who was hearing his petition to deportation in a Maryland district court, ruled that he must now adhere to the terms of his bond from custody in Tennessee. This order shifts his supervision to the Tennessee court.
